CVFormatter is a software-as-a-service ("SaaS") product developed and offered by Aimanack LLC, a limited liability company incorporated in the State of Wyoming, United States ("CVFormatter", "we", "us", or "our"). By accessing or using CVFormatter, you ("you" or the "Client") enter into a legally binding agreement with Aimanack LLC for the provision of the CVFormatter services.

These Terms & Conditions apply to the CVFormatter website, platform, and all related communications between you and CVFormatter. By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

CVFormatter is committed to protecting personal data in accordance with applicable data protection laws. Where the Client is subject to the EU General Data Protection Regulation (GDPR), the UK GDPR, or similar data protection legislation, the Client acts as the Data Controller with respect to personal data submitted to the Service, and CVFormatter acts as the Data Processor, processing such data solely on the Client's documented instructions, as further described in our Privacy Policy and Security & Data Processing Overview. For Clients based in the United States, CVFormatter complies with applicable US federal and state privacy laws, including where relevant the California Consumer Privacy Act (CCPA).

Where required by applicable data protection laws, CVFormatter will enter into a Data Processing Agreement (DPA) with the Client. A GDPR-compliant DPA is available upon request and may be executed between the parties.

CVFormatter grants you a revocable, non-exclusive, non-transferable, limited license to access and use the Service strictly in accordance with these Terms & Conditions.

You may not:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Service
• Modify, reverse engineer, decrypt, or create derivative works of any part of the Service
• Remove or obscure any proprietary notices

• Third-Party Services: Services provided by third parties not controlled by CVFormatter

If you subscribe to a paid plan, you agree to pay all applicable fees in accordance with the pricing and billing terms in effect at the time of purchase. CVFormatter reserves the right to change pricing and billing methods upon notice.

You are responsible for maintaining accurate billing information and for any third-party fees incurred while using the Service. All fees are quoted and charged in US Dollars (USD) unless otherwise stated.

If you are not satisfied with the Service, you may contact CVFormatter within thirty (30) days of purchase to request a refund. Refund requests will be reviewed on a case-by-case basis and processed in accordance with applicable laws and payment provider requirements.

Any feedback, comments, or suggestions relating to improvements of the Service ("Suggestions") may be used by CVFormatter for product development purposes. This clause does not apply to Client confidential information or personal data processed under the Service.

The Service may include links to or integrations with third-party services. CVFormatter is not responsible for the content, security, or practices of third-party services, which are governed by their own terms and policies.

CVFormatter implements reasonable technical and organisational measures designed to protect personal data, as described in our Privacy Policy and Security & Data Processing Overview.

CVFormatter will notify the Client without undue delay upon becoming aware of a personal data breach affecting the Client's data, in accordance with applicable data protection laws.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, CVFormatter disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in this section limits CVFormatter's obligation to implement reasonable security measures or comply with applicable data protection laws.

To the maximum extent permitted by applicable law, CVFormatter shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or business interruption.

Nothing in this Agreement shall exclude or limit CVFormatter's liability arising from its breach of applicable data protection laws, including its obligations as a data processor, or from gross negligence or wilful misconduct.

CVFormatter's total liability under this Agreement shall not exceed the amount paid by the Client for the Service during the twelve (12) months preceding the claim.

This Agreement remains in effect until terminated by either party. CVFormatter may suspend or terminate access for violation of these Terms. Upon termination, you must cease all use of the Service.

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. CVFormatter is incorporated in Wyoming and provides its Services globally. The Service is delivered through secure cloud infrastructure and operated by a distributed team, as described in our Privacy Policy and Security & Data Processing Overview.

Clients based in the European Union or United Kingdom acknowledge that data may be transferred to and processed in the United States. Such transfers are conducted in accordance with applicable data transfer mechanisms, including Standard Contractual Clauses where required.

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, administered in Sheridan, Wyoming, United States, except where injunctive relief is sought for intellectual property protection. You agree to bring any claim on an individual basis only, and not as part of any class or representative proceeding.

CVFormatter may update these Terms from time to time. Material changes will be notified in advance where required by law. Continued use of the Service constitutes acceptance of the updated Terms.

These Terms, together with the Privacy Policy and Security & Data Processing Overview, constitute the entire agreement between you and CVFormatter regarding the Service.
